Ha‘aheo Chan of Mountain View, who was arrested and charged in relation to the theft of a John Deere ATV originally reported stolen from the Kea‘au High School campus, recently made his initial appearance in Hilo District Court where over Prosecutors’ objections, the District Court judge granted him supervised release and ordered him to appear for a preliminary hearing on August 19.
As the Complaint alleges, Chan is charged with Theft in the First Degree and Unauthorized Control of a Propelled Vehicle in the First Degree. Theft in the First Degree is a class B felony offense and carries either a penalty of ten years in prison or four years probation and up to eighteen months in jail. Unauthorized Control of a Propelled Vehicle in the First Degree is a class C felony offense which carries either a penalty of a five-year prison term or four years probation and up twelve months in jail.
The charges are merely allegations, and the Defendant is presumed innocent until proven guilty.
The case is being prosecuted by Deputy Prosecuting Attorney Ryan Caday.
